Don't know if this is here already, but it has been posted recently to the T&C on neopets.

There are also like 20 boards on this in the battledome chat.

"You agree not to design, disseminate or use any third party programs designed to change the game play on the site including, but without limitations, programs such as autobuyers, flash game cheats, autofreshers, and snipers. Any use, dissemination or design of such programs is a breach of these Terms you will be responsible for any resulting damages to Neopets. You agree that if you disseminate, design or assist in the design of a third party program that changes the game play on Neopets, you will pay NeoPets, Inc. liquidated damages in the sum of Fifty Thousand Dollars for each such program as liquidated damages. You agree that if you use such a program on the neopets.com website, you will pay NeoPets, Inc. liquidated damages in the sum of Five Hundred Dollars for each time you use a program."

What are the odds they will enforce this?

Since they're bloody capitalists, the odds are very high, approaching infinity... the question, however, is not 'will they?' but rather 'how?"...

I'm not sure if they will enforce it well since a lot of people use programs and sending out that many subpoenas is hard. also, whats the legality of them doing that. as changing gameplay does not cause 500 dollars worth of damage.

There are several legal routes they can take....revenue loss from ads not clicked by players who quit because they can't RS will probably be the main reason.

But since MANY of the players are underage, Neo would have to sue the parents.

This should be interesting.

well, I dont turn 18 for a good few months. in that time, they should have some subpoenas sent out. dont they have to prove an amount of members who cant rs well along with how many of those actually click ads?

They could use a rough estimate.....# of total members / # of ads clicked....then they would have to multiply that by the # of documented users who quit because of the RS problem.

It is a sliding scale.....their lawyers will come up with something.

yeah...but what about this, people were disbecausesing it:

they claim that we cant use third party programs to change gameplay. firefox and IE are third party programs that change gameplay since without them there would be no gameplay and since there is, that is a change.

No no no, IE is meant to actually IMPEDE any changes by constantly returning critical errors!

And it's the same thing again: HOW are they supposed to sue let's say... 100k people? Esp. when they don't have accurate personal information other than the IP? Sure, that's still possible on a small scale (several people), but it would take a whole army of hackers to find out that much info (and a big country's budget to pay them!)

EDIT: Also, that verschwörungtheorie about lost clicks on ads isn't worth a shit... what about people using firefox with the ad-block installed (like me)?

So if I use a program, and am not sued, can I sue TNT for not adhering to their TOS?
